Earlier this week, Greater Manchester Police released the home address of a suspect accused of starting a fire during the riots.

GM Police said they had charged 18-year-old Dane Williamson from Salford with criminal damage.

Williamson has now had his own flat burnt down in what is likely to be retaliatory action.

They published his home address online and tweeted the details.

Google search results

Then they deleted the page (first link on Google) with his details.

When interviewed, Williamson admitted he had been in the vicinity earlier that day but had left by the time of the incident and was on a bus on the way to his brother’s house. He claims its a case of mistaken identity.

Now the flat of the suspect has been burnt down.

At first the police stated it was not a deliberate fire, but later admitted they suspected foul play.

Is it right the police should be publishing personal details of suspects, even before they have been convicted?

Yes, justice requires the publication of the names of people who are being prosecuted. There are exceptions for those who are not yet 18, of course. The countries where the names of people are not published tend to be those where people who have been arrested disappear.

Providing more information about the accused is voluntary at this stage but will be revealed in court shortly afterwards. For those who have a common name (eg John Wilson), details about the accused are helpful; John Wilson, the hospice volunteer, will be thankful that press reports make it clear that he is older than John Wilson, alleged child abuser and lives at the other end of the city.

Publishing faces and names of suspects who’ve absconded is fair enough but publishing the address of a suspect serves no purpose that I can see, are they asking members of the public to send them screenshots of google maps?

It’s a crime to retaliate, of course. Still, publishing details of the accused is common practise in Britain (though not in all countries).

An alternative: change the law so that no one cant publish details before conviction (and for convictions, the punishment has to above a certain threshold). Protect the home addresses and other data of the accused. But this would of course apply not only to rioters an looters, but also bankers and fraudster MPs, right? You really want more of that super-injunction nonsense?

some of the poeple criticisng the blokes name being released are the same people that reckon anyone arrested fo rape should have their name dragged through the dirt.

Sorry Sunny, you’re obviously not used to receiving police press releases. This is absolutely standard practice. Here’s one randomly chosen from a few weeks ago.

The system we have identifies those charged with crimes, so justice can be seen to be done. Standard practice is to give name, DOB and street. There are complexities to that, most obviously the debate around rape anonymity as mentioned above, but on balance the practice is probably right.

No scandal here.

I’m not allowed to know where my MP lives in case I go round and in a fit of pique torch his third ‘second home’ (more properly so that I do not get to know how many times he has ‘legitimately’ avoided paying capital gains tax).
However, I can now discover the address of an individual charged but not convicted of a crime – presumably so that I may write to him to express either my surprise or disappointment
Will the police now publish the addresses of individuals charged with child abuse?
Or maybe the addresses of all those policemen convicted of data protection issues.
Perhaps the coalition could look again at the ‘D’ notice that prevented the press exposing the names of individuals under investigation for child abus under ‘Operation Ore’.
Why was it so important that we cannot be told.
Perhaps an associate of Mr Blair could tell us what exactly was the issue of national security?

A decent defence brief would argue the right to a fair trial had been prejudiced by police publishing too many details of a defendant.

Have you never read a local paper? They always mention the road on which subjects live, including those who have committed crimes. In fact, even the BBC do it: http://www.bbc.co.uk/news/uk-england-manchester-14362385 “Ms Leighton, of Buxton Road, appeared on videolink at Manchester Crown Court.”

In the 2008 election, the South Wales Evening post published a typical “Councillor fury at BNP candidate” story (the story was that Labour candidates said they didn’t like the BNP) – and in the story they managed to work in the home address of every single BNP candidate in Swansea.

I think Laban is arguing that standing for election for the BNP is morally equivalent to kicking in people’s windows and razing buildings to the ground. I would agree.

Police can/do name people they’d like “to help them with their enquiries.”

Once a suspect is charged, the case becomes “active” and it is not normal for the press/police themselves to go into details at this stage. In fact, it may be contempt of court for the press to do so. (evidently things done changed in this twitter age eh?)

The name, age, address and profession of a charged suspect is normally first published *following* the first appearance at magistrate’s court.

In this instance, the police chose (unwisely imo) to broadcast a suspect’s identity at the ‘active’ stage of proceedings. There was no clear benefit in doing so and in fact, it doesn’t take a genius to figure out that what did happen would happen.

Police going online with twitter feeds and crime maps is the latest example of PC Plod becoming infatuated with a novel technology without ever first figuring out how, when or even if to use it (see also tasers, CS spray and guns). I don’t like this tweet-first-ask-questions-later attitude – no matter whether it’s the local saint or known scrote, I’d like to hope that the rule of law and due procedure apply to us all.

No no no no no. This is just wrong.

When someone is charged with a crime, the police routinely release their name, identifying details (usually DOB and street, but not house number), and what they have been charged with. The media are then free to report those details, but nothing else. Any speculation about guilt or innocence, or anything that might prejudice evidence presented in court, can be ruled as contempt.

It’s what happens in child abuse cases, rape cases, murder cases, fraud cases etc etc etc.

There are actually very good reasons for this in jurisprudence and constitutional rights. This is part of the protection we have to ensure we don’t get secret trials going on. If I happened to know Dane WIlliamson, and had seen him on the other side of town at the time he was meant to be burning down Miss Selfridges, it is good that I know what he has been charged with.

It’s bad enough that we’re seeing these showtrials and ludicrous sentences. Please don’t open the door towards secret trials as well.

I’m sorry but I don’t buy this.

First, rape cases are different and anonymity in such cases is a bad idea for several reasons.

Secondly, we have a highly unusual scenario here, whereby a large group of people are not only being pushed through the courts very quickly, but are being given life-destroying sentences without little recourse to proper representation.

In addition to that, the press is whipping up anger against all of them (fair enough, anger at a good proportion of them is understandable) – when not all did the same thing. In such a scenario – the danger of vigilante action is real. And this is exactly what happened here. The man has not even been convicted and yet he’s already faced reprisal attacks.

What if more of this happens? You’d still be complaining that any temporary stop on publishing home details is akin to closed military trials? That’s just ludicrous.

Yeah, um, Sunny? This is normal. Obviously, not retaliatory arson attacks, but publication of details. It used to be the local paper back when everyone read the local papers, now it’s also the internet, IIRC there’s a duty to publicise although I suspect Ally knows more and will correct me if I’m wrong.

Since I moved in with Jennie in this quiet side street in West Yorks three people in this street of 24 houses have been in court for a variety of things, including domestic violence (still helping out with that one). Justice must be done, justice must be seen to be done.

It’d take a massive amount of pressure to change this, it’s the way things have been done for centuries (used to be pinned to the parish noticeboard before newspapers).

Barrie, not sure why your MPs address is secret, when I ran for election to the council my home address was on the council website and in every polling station, my MPs then address was as well. There are ways you can not put your home address up, but you need actual reasons IIRC.

Pretty unlucky that he lived in the only flat in the only building on Broughton St. Salford. Otherwise the arsonist would have had to have known independentally where he lived. Still, never mind, eh Sunny?

That’s quite an allegation. Have you any evidence that people are being tried without recourse to legal representation?

Perhaps you could write a longer article in which you actually set out your thoughts, your considerations and deliberations, on this question. At the moment, it just sounds like you’re surprisingly ignorant of basic principles of justice.

Did they publish the number of his flat? I don’t think they did. It is usual practice to refer to suspects who have been charged with crimes, giving the street and area they live in.

And just to clarify, his flat wasn’t ‘burnt down’ entirely- the damage was confined to the bedroom. Dramatizing the details reduces credibility.

The footage showing the boy who burnt down the shop is very clear, I would be shocked if the police had made a mistake.

In all, it’s pretty difficult to hold the police responsible for this boy’s flat being damaged.

I’ll be honest, I think there is a much stronger case for anonymity in those cases than there is here, due to the fact that the accuser already has anonymity.

I broadly agree with that, but I fail to see what difference it makes if the defendant is identified or anonymous. As I say, the dangers of people being effectively tried in secret are far greater from a human rights, civil liberties POV.

Agree with this too, but you’re at risk of arguing that accused should be identified unless the alleged crime is serious enough for anyone to care. Again, rapists? Child sex abusers?

At this point I should note that reports are very confused as to whether this even was an arson attack or not. It seems highly likely it was an accident.

I don’t know, but I’d hazard a guess that the address is now being investigated as a possible crime scene itself (arson) and they don’t want every nosy parker, paparazzo and cheap hack in Manchester crawling all over it, trying to get a glimpse ‘inside the flat of the Selfridge’s arsonist’

Hmmmm… is this the right time to bring up the old issue of anonymity for those accused of rape? If it’s not ok to identify suspected rioters and looters, then it’s not ok to identify rape suspects either.

Many however have argued that it is important to identify rape suspects in order that others affected might be able to come foreward as witnesses.

We can argue about whether or not this is a good idea, however I suspect that it is necessary under our adversarial criminal / judicial system. If we were to have an inquisitorial system with investigating judges / magistrates then I might well come up with a different answer.

Two basic, gigantic misunderstandings have surfaced here. They can both be cleared up pretty quickly:

1.) Is it right the police should be publishing personal details of suspects, even before they have been convicted?

Yes. It’s standard practice for a number of reasons. Broadly, because we have a justice system that’s based on holding individuals to account for their actions. There is a presumption in the English court system that defendants should be named unless there is a compelling reason not to (most commonly because they’re under 18). This also applies to witnesses, who haven’t been accused of any crime. If the courts want to make people anonymous they have to make an order, which can be challenged by the media (exceptions include children in youth courts and victims in rape cases). Ages and addresses are published so that people in the same town with the same name aren’t wrongly vilified. It’s seen as part of making the justice system accountable. If you want to argue for a new system of court orders to protect people from retribution then that might make for an interesting debate, but the police have done nothing wrong or unusual in releasing this man’s name.

2.) If it were to stop happening, we’d be in a very different place. Like Burma. Or Iran.

Um, or we could be less hysterical and suggest the Netherlands, where defendants – and convicts – are entitled to anonymity right through the judicial process. Dutch politics may be going through a turbulent time at the moment, but it’s hardly Burma.

Be very careful here – the terms “anonymity” and “accuser” have a few different meanings, and you’re blending them together in a way that doesn’t give an entirely accurate impression.

In a rape case the victim’s identity may not be reported by the press, but is otherwise public – and will be very obvious to anyone attending the public court proceedings, of course. (Note that the victim need not be the accuser, and if the crime is reported to the police by a third party, that reporter does not get even press anonymity unless reporting their name would identify the victim)

In a riot-related case – theft, arson, etc. – it’s entirely possible for the reporter/accuser to have anonymity. In fact, it’s encouraged in some cases. That’s absolute “no-one knows who you are not even the court” anonymity there (though unless the police find other evidence when following up that lead it won’t get to court, of course) – far stronger than the very limited media anonymity that courts may grant.

So let’s see – there was a mob of angry people calling for him to be set on fire, then GMP gave out his address, which was linked to from the facebook group trying to identify him, then his house was set on fire.

No it isn’t right!! Dane has now been released after it was found to be mistaken identity! But he can’t exactly go back home!! What happened to innocent until proven guilty! Disgusting!

Names maybe but I’ve always thought it was too much to publish the road they live in.

The police published an innocent person’s address, implying that he was an arsonist. Now the people who were calling for the arsonist’s house to be burned in retaliation have an address and the innocent man’s home gets burned down. The police facilitated the crime and is responsible (along with the retaliatory arsonists) for the damage caused. They should face the same law the rioters faced (ignoring regular sentencing practices in favour of longer sentences), since they facilitated a riot-related crime.
